In these Terms and Conditions, the following expressions have the meanings set out below:
Customer means the person, business, company, or organisation booking or receiving services from Rubbish Removal Kennington.
Services means any rubbish removal, waste clearance, waste collection, recycling, loading, transportation, or related services provided by us.
Waste means any rubbish, general waste, household waste, garden waste, office waste, construction and demolition waste, or other materials which the Customer asks us to remove, subject always to applicable waste regulations and these terms.
Site means the location where the Customer requests that our services are carried out.

We provide rubbish removal and waste collection services for domestic and commercial customers. Our services typically include loading waste onto our vehicle, transporting it for lawful disposal or recycling, and leaving the Site in a tidy condition as reasonably practicable, subject to access and safety conditions.
The exact scope of work for each job will be confirmed at the time of booking or during an on-site assessment. Any quote is based on the information provided by the Customer and may be adjusted if the actual volume, type, or location of the waste differs from that described.
Bookings for rubbish removal services can be made by telephone, email, or through any booking system we make available. When placing an order, the Customer must provide accurate details of the Site address, access conditions, parking availability, type and approximate volume of waste, and any other relevant information.
A booking is considered an offer by the Customer to purchase services in accordance with these terms. We reserve the right to accept or decline any booking. Our acceptance will normally be confirmed by verbal confirmation, written confirmation, or by our team arriving on Site to perform the services.
We may request photographs or additional information in order to provide an accurate estimate. Any time and date for service provided at the booking stage are approximate and subject to availability, traffic, and operational factors. We will use reasonable efforts to attend within the agreed time window but do not guarantee exact arrival times.
Any quotation provided is based on the information supplied by the Customer and is usually calculated according to the volume of waste, type of waste, weight, labour time, access conditions, and any disposal charges or regulatory requirements applicable to the waste in question.
We reserve the right to amend the quoted price if, upon arrival, the quantity or nature of the waste differs from that originally described, if access is significantly more difficult, if additional labour or equipment is required, or if regulatory disposal charges are higher than anticipated. In such cases, we will explain the reasons for any price change before proceeding.
All prices are quoted in pounds sterling. Unless expressly stated otherwise, prices are exclusive of any applicable taxes which will be added at the prevailing rate where required by law.
Payment is due on completion of the services on the day of collection unless alternative arrangements have been agreed in advance in writing. We may accept payment by cash, bank transfer, or card payment, subject to the payment methods that we offer at the time of service.
For business customers or larger projects, we may issue an invoice in accordance with an agreed payment schedule. Invoices are payable by the due date stated on the invoice. If no date is specified, invoices are due within 7 days of the invoice date.
If payment is not received when due, we reserve the right to charge interest on the overdue amount at the statutory rate applicable to late payments in the UK, accruing on a daily basis until payment is made in full. We may also suspend further services to the Customer until all outstanding sums have been paid.
The Customer may cancel or reschedule a booking by giving us reasonable notice. To avoid cancellation charges, we ask that cancellations or changes are communicated at least 24 hours before the agreed arrival time.
If a booking is cancelled with less than 24 hours notice, we reserve the right to charge a cancellation fee to cover our administrative costs and any lost time. If our team arrives on Site at the agreed time and is unable to carry out the services for reasons beyond our control, including lack of access, absence of the Customer or authorised representative, incorrect address details, or unsafe working conditions, this may be treated as a late cancellation and a call-out or cancellation fee may apply.
We may cancel or reschedule a booking if we are unable to perform the services due to circumstances beyond our reasonable control, including severe weather, traffic disruption, vehicle breakdown, accident, illness, or compliance with legal obligations. In such instances, we will use reasonable efforts to inform the Customer as soon as possible and arrange an alternative time.
The Customer is responsible for ensuring that we have safe and reasonable access to the Site, including suitable parking for our vehicle as close as possible to the waste to be collected. Any parking charges, permits, or restrictions are the responsibility of the Customer, and any fines incurred as a direct result of inaccurate information or instructions may be chargeable to the Customer.
The Customer must ensure that waste to be collected is clearly identified and separated where necessary. Hazardous or prohibited items must not be mixed with general waste. If the Customer or their representative is present, they must be available to show our team which items are to be removed and to confirm completion of the work.
The Customer must not request that our staff undertake any work that is unsafe, illegal, or outside the scope of our services. We reserve the right to refuse to carry out any part of the services if we consider that it would be unsafe or would breach legal or regulatory requirements.
We handle a wide range of non-hazardous rubbish and waste, including household waste, office waste, bulky items, garden waste, and certain types of construction and renovation waste. All waste must be capable of being loaded safely and legally onto our vehicles.
Some items are classified as hazardous or require special handling or disposal under UK waste regulations. These may include, but are not limited to, asbestos, clinical waste, chemicals, oils, solvents, gas cylinders, certain electrical items, batteries, and any materials that are explosive, highly flammable, toxic, or otherwise dangerous.
We are not obliged to remove any items that we reasonably believe are hazardous or that we are not licensed or insured to carry. If such items are discovered during the course of the job, we may either refuse to remove them or agree to a revised service, subject to additional charges and compliance with relevant regulations.
We operate in accordance with applicable UK waste management legislation and regulations. This may include requirements relating to waste carrier registration, duty of care for waste transfer, segregation of materials, and proper disposal or recycling at authorised facilities.
Where required, we will arrange for waste to be transported and disposed of only at licensed waste transfer stations, recycling centres, or treatment facilities. We will take reasonable steps to ensure that waste is handled responsibly and in a manner that minimises environmental impact, where practicable.
The Customer confirms that any waste presented for collection is their property or that they have the authority to arrange its removal. The Customer agrees to provide any information reasonably requested in order to comply with waste transfer and duty of care requirements.
We will exercise reasonable skill and care in providing our services. However, our liability to the Customer is limited as set out below.
We will not be liable for any loss of profits, loss of business, loss of opportunity, loss of goodwill, or any indirect or consequential loss or damage arising out of or in connection with our services, whether in contract, tort, or otherwise.
We will not be liable for any damage caused to driveways, paths, surfaces, or underground services where the Customer has requested that our vehicles or staff access a particular area and such access is necessary for performance of the services, provided we have acted with reasonable care. The Customer is responsible for pointing out any known issues or weaknesses at the Site that may be affected by vehicle or foot access.
If we are found liable for any loss or damage arising directly from our negligence or breach of these terms, our total liability to the Customer shall be limited to the total price paid or payable for the specific services giving rise to the claim, unless a higher limit is required by law.
Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited by law.
We maintain insurance cover appropriate to the nature of our waste removal activities, including public liability insurance, subject to the terms, conditions, and exclusions of our policies. Details of cover may be made available to customers on request.
Ownership of the waste passes from the Customer to us at the point when the waste is loaded onto our vehicle, provided that we are legally able to accept the waste and that all necessary information has been provided. Once ownership has passed, we are responsible for the lawful transportation and disposal of that waste.
Risk of loss or damage to the waste transfers to us once it is safely loaded onto our vehicle. Until that point, the waste remains at the Customer's risk.
We will not be in breach of these Terms and Conditions or liable for any failure or delay in performing any of our obligations where such failure or delay results from events, circumstances, or causes beyond our reasonable control. These may include extreme weather, natural disasters, accidents, fire, flood, traffic disruption, strikes, lock-outs, acts of terrorism, war, government restrictions, or failure of utilities or transport networks.
If you are dissatisfied with any aspect of our rubbish removal or waste collection service, you should notify us as soon as possible so that we have an opportunity to investigate and, where appropriate, put things right. We may ask for photographs or other information to assist in resolving any issue.
We aim to deal with complaints fairly and promptly. If a dispute cannot be resolved informally, either party may consider using mediation or other forms of alternative dispute resolution before resorting to court proceedings, although this is not a requirement.
In the course of providing services, we may collect and process personal data such as names, contact details, addresses, and billing information. We will handle such data in accordance with applicable UK data protection laws and only use it for legitimate purposes connected with the provision of our services, accounting, and legal compliance.
We will take reasonable steps to keep personal information secure and will not sell or disclose it to third parties except where required by law or where necessary to perform our services, for example to payment processors or waste disposal partners.
We may update or amend these Terms and Conditions from time to time to reflect changes in law, industry practice, or our operational requirements. The version in force at the time of your booking will apply to that booking. Continued use of our services after changes have been made will be treated as acceptance of the updated terms.
If any provision or part of a provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful, or unenforceable, that provision or part will be deemed deleted, but the remaining provisions will continue in full force and effect.
These Terms and Conditions and any dispute or claim arising out of or in connection with them, or with any rubbish removal or waste collection services provided by us, shall be governed by and construed in accordance with the laws of England and Wales.
The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter, except that we retain the right to bring proceedings against the Customer in any other court of competent jurisdiction where permitted by law.
These Terms and Conditions, together with any written quotation or service confirmation provided by us, represent the entire agreement between the Customer and Rubbish Removal Kennington in relation to the provision of our services. No other terms, conditions, or representations, whether oral or written, shall form part of this agreement unless expressly agreed in writing by us.
